Research On Restricting Competitive Behavior Of Industry Association

In the modern market economy, trade association as a social organization of industry, plays a linking role between the market and the government, promoting the interaction of the government and the market. Trade association has an intimate relationship with competition, which could promote it or not. And with the development of market-oriented economy&autonomous society (Economic mercerization and social autonomy) and the reformation of trade management system, trade association, as a link between market and government, develops comprehensively so as to play an important role in communicating and coordinating government and society. However, the trade association in China goes through the planned economy, so it shows some problems, such as the disorder of trade association system, the lack of autonomy and the big gap between the theories and reality of trade association. Besides, China’s market economy has not been mature yet, and the rule of fair competition neither enjoyed a popular support. What’s more, the trade association has implemented the restrictive competition frequently just for the benefits of its own member enterprises. Although China’s Anti-monopoly Law has made provisions on the restrictive competition of trade association, it still need to promote and perfect the definition of trade association’s legal functions, the main types of restrictive means, and its legal responsibility. Thus, it can not only regulate the behaviors of restrictive competition in society, but also improve the implementation of China’s Anti-monopoly Law and then build a fair and free competitive market order.
