In criminal procedure activity, What we said that judges always play thevital role is indisputable.The Criminal trial results are run counter to other cases ofresults of trials,Because the criminal trial results are tend to have more closerelationship with the parties to their matter of deep personal concern interests, andeven the rights of their freedom and life.When the judges is under the trial, the mostideal result is get a fair trial results, and then resolve disputes properly.The solution ofthe legal dispute, however, making the right trial results, will always have a closerelationship to each intermediate link and the judge’s role in procedure activity.Therefore, analysis and study the role of judge in criminal criminal prosecutionthrough each link of the process of trial, The judges can be regard as the shoulderresponsibility of the justice of judicial reform in the future-the role of judges andreconstructing the judge role puts forward corresponding path and method, so as torealize the goal of judicial justice.This article makes the role theory of sociology as the perspective in it, takeadvantage of analysis about cases in which people were unjustly,falsely or wronglycharged or sentenced, using method of process analysis and empirical study, makinganalysis to the judges in the trial of criminal proceedings in each link and positioningthe role of the judge. The role of the judge reconstruction idea, is a huge project, needthe change of the external surroundings and judge’s themselves efforts for the legalprofessional role.The goal that in the pursuit of justice at the same time to ensure thatthe judge role on the right of position and get a fair trial.The introduction is mainly introducing the question of research into thisarticle briefly in the paper, the necessity of the study and methods and characterresearch in this article.Ranging from the first chapter to the fifth chapter, the court investigationcross-examination link, and link of collegiate bench link, criminal reconciliation andcourt decisions, analysis the praticle role of judge played in each link of the actualdata obtained through investigation and research, and combined with the related caseanalysis, empirical argument, clear roles and positioning of the judge. In the last chapter, it is according to the result of empirical study, therefactoring role of judges in the judicial reform in the future which is presented, andthrough the way of targeted measures, putting forward the solution, making efforts tothe judge justice, protecting and supporting the judicial justice.
