The ocean is the human survival and development of new space, the21st century isthe new century of meeting and developing and protecting the ocean.“United Nationsconvention on the law” on the basis of the old treaty of ocean, the world’s oceans aredivided into different legal status of sea areas, new changes have taken place in thatmakes the ocean order. Our country is the United Nations convention on the law of thecontracting states, how to combine the characteristics of the current Marine legal systemin China, within the framework of the convention, how to maintain our country’smaritime rights and interests, the development of Marine economy in China, processingand solve the problem of ocean in our country at present, about the future developmentof ocean in our country. Feasible comprehensive Marine law, existing Marine policiesand measures in law cure, to perfect our country’s Marine system, promote thetransformation from regional maritime power to ocean world powers is of greatsignificance.In this paper, there are four parts in structure. Chapter1mainly introduces thesituation of lawmaking for the Marine law and the characteristics of the legal system;chapter2mainly introduces the UN convention on the law of the sea establishing thenew system of ocean, the resulting impact on the Marine policy, analyses the conventionstill exist deficiencies; chapter3to the disadvantage of our Marine legislation as thebreakthrough point, expounds the necessity and feasibility of the basic law of ourcountry to set; chapter4contrast within the UN convention on the law of the sea system,compared the ocean legal problems still exist in our country, puts forward the basic lawof Chinese maritime legislation guiding ideology and its contents.
