Locke and Rousseau thought the rule of law is the history of the developmentprocess on behalf of thinkers, but also the rule of law in the bourgeois revolutionideological heritage and development representatives. In Locke’s " Two Treatises ofGovernment " and Rousseau’s " Social Contract" which embodies both political andlegal thought. Locke collection of a number of previous theories, proposed the conceptof decentralization of government ideology and social contract. Rousseau was firstmentioned consensual thinking people in society, and laid a solid theoreticalfoundation for the development of the social contract idea.Locke is the natural state of human natural rights of its ideological foundation ofthe social contract. People signed by the contract between the government and theright way to make the government division of the people ’s freedom and equality beguaranteed. Rousseau’s Social Contract Theory and Locke same place is alsoestablished under the natural state. But Rousseau men are created equal, the use bythe general will establish a community to protect the fundamental rights of the people.By this point also reflects the ideological differences between the two contracts exist.In this paper, the origins of the social contract idea is the starting point fordiscussion on the historical background and theoretical origins of Locke and Rousseau’s social contract thought to produce a comparative analysis, which found a differentpoint and further research. By comparison with the same ideas of both the socialcontract and political theory, political and legal thinking on their further exploration.And absorb the essence of which provide theoretical guidance for the rule of law in oursociety.
