Personal Privacy Protection In The Process Of Government Information Disclosure

The disclosure of government information is the support and maintenance to public’s right to know, the guarantee to achieve management goals of modern government, the basic way to provide social service. In theory, the publicity is at the expense of reasonable personal privacy for public interest, but in reality, the government can neither use the information in accordance with its gathering purpose nor provide absolute security of personal privacy stored information, which result in the phenomenon of using "personal privacy" to safeguard its own interest. In this case, the individual’s privacy interests are often subjects to abuse, a so-called "Holloman" Thus, it is particular urgent to defining the scope of personal privacy and develop appropriate legal protection regime. In this paper, the writer will make a scrutiny into the major legal issues and theoretical confusion of personal privacy protection by using empirical analysis, comparative analysis and other methods, then put forward some suggestions on how to coordinate the government information disclosure and personal privacy from the aspects of basic concepts and specific system, hoping to alleviate the conflict between protecting citizen’s right to know and the disclosure of government information.Protection of citizens’right to know and privacy is an important manifestation of respecting and safeguarding human rights. The government should reflect the significance value of personal privacy and the right to know in the way of carrying out its administrative functions and implementation. If the protection of personal privacy and disclosure of government information can’t be done integrated, coordinated or comprehensive, then the basis human rights will inevitably face a very serious threat. By studying the status of personal privacy legislation and judicial cases, this thesis will point out the problems in protecting personal privacy and their causes, reveal the conflict between private protection and disclosure of government information, then analysis the connotation of personal privacy from the aspects of public law and private law, come up with some constructive suggestions according to the problems faced in process of legislation and judiciary. Trying to figure out the connotation and denotation of personal privacy in disclosure process, hoping to resolve the conflict between protecting citizen’s right to know and the disclosure of government information.
