Research On The Protection Of Personal Privacy In Government Information Disclosure

At present,all countries in the world are actively promoting government information disclosure,and China is no exception."The People's Republic of China Government Information Disclosure Ordinance"(hereinafter referred to as the "Regulations on open government information")since the implementation of government information disclosure work in China to a new level,but in practice often occurs the government information disclosure cases infringe the rights of privacy of citizens.Improving the transparency of government work is the proper meaning of building a service-oriented government,but we cannot ignore the boundary of government information disclosure.The protection of personal privacy is a yardstick for testing the openness of government information.China's government information disclosure work has been carried out late,there are many imperfect places,this article through the analysis of specific cases,find some of the common problems,and put forward some suggestions,hoping to provide reference for solving such problems.The text of this paper is divided into five parts.The first part is the introduction of the case and the focus analysis of the dispute.Through the analysis of the focus of the dispute,it summarizes the problems in the case.The second part briefly introduces the relationship between the government information disclosure and the protection of personal privacy,which briefly expounds the nature of the government information disclosure,and discusses what is the personal privacy in the public information disclosure.The third part,through a profound analysis of the case,puts forward the problems of imperfect related laws,the unsound administrative procedures to protect the right to privacy and the insufficiency of the relief when the rights are infringed.The fourth part gets the inspiration to our country through the summary of the personal privacy protection legal system in the information disclosure of the United States,Germany and the Japanese government,and the fifth part is aimed at the questions raised.With the experience of foreign countries,some pertinent suggestions are put forward.First,we should perfect the legislation and formulate relevant legal norms as soon as possible.Secondly,we should improve the administrative procedure of protecting the privacy of personal privacy in the public information disclosure.Finally,we should perfect the way of relief and establish a complete set of protection system of personal privacy in the public information disclosure.
