This paper aims to figure out the existed problems in the non-motorized traffic related rules in P.R. China and gives suggestions of how to improve the regulations and governance mode.The writer explores non-motorized vehicle governance mode from four aspects:definition of non-motorized vehicle, driver’s permit rules for non-motorized vehicles, determination of liability in non-motorized vehicle related accidents, and compulsory insurance requirements for the non-motorized vehicles.In the first part of the paper, the writer will briefly introduce the current status of the non-motorized vehicle governance mode in China at the very beginning. Next, redefine the non-motorized vehicle, which excludes motorized bicycle, motorized scooter, and LPG gas scooters. Thirdly, combined with the limitation of legislation, legislative system, and the effect of the governance policy, the writer will spot the issues of non-motorized vehicle governance. Later, she gives successful governance experience from Germany, Italy, Hong Kong, and South Korea. In the progress of urbanization, the writer holds the opinion that motorized bicycle, motorized scooter, and LPG gas scooter remain critical roles in people’s daily life in China, which is similar to South Korea. Thus, Chinese government may introduce experience from South Korea and restructure the current governance mode. At the same time, it is pointed out that the new governance mode should be in conformity with local conditions and the government must consider the differences among costal area, like Shanghai, developing area, like Jiangxi province, and mid-west area, like Sichuan province.In the second part of the paper, the writer will readdress the issues in the Chinese non-motorized vehicle governance system:definition of non-motorized vehicles, management system of non-motorized vehicle drivers, non-motorized vehicle compulsory insurance, and determination of liability between motor vehicle and non-motorized vehicle in the traffic accident. The writer suggests establishing a driver’s permit system for non-motorized vehicle riders. Also, she states that the riders of motorized bicycle, motorized scooter, and LPG gas scooters must be strictly governed by Criminal Law of PRC and will be accused of committing DUI offense while they drive drunk.Finally, the paper will be concluded by writer’s further suggestions of restructuring non-motorized vehicle governance mode mainly in the areas of redefining the non-motorized vehicle, quality standard requirements for non-motorized vehicle manufactures, and necessity of compulsory insurance system. It is also noted that feasibility study should be made in advance.
