Conflict And Balance Of International Labor Rights Protection And Its Impact On China

To protect the rights of laborers is an important task which is connected with the property of country and stability of society. At present, there are several standards over the world and there are severe conflicts among them. These standards are international core labor standard, the social clause of WTO and SA8000.At the beginning, the protection of international labor means generalization of many implements. But when the standards of international labor came out, the protection of international labor largely means the implement of these standards. This article introduces the contents of these standards. It is a rather difficult task to coordinate different standards, but it seems formidable to cooperate between these international organizations who advocate individual standard. With the globalization of economy, these standards avoidably exert much influence on China. This article not only points out the achievements of our laborers protection, but also explains some problems that need improvement. In addition, this article advocates our own standards which include three items-the social responsibility of enterprise, golden clause, service clause. We should improve labor legalization from many aspects in order to participate in the globalization of economy in a responsible and relaxed manner.This article uses the method of historical analysis, describing the development course of different standards. By comparison, their values and shortcomings turn out. On this basis, our own standards come out, which can promote the improvement of our labor protection, so that we labors can enjoy enough rights and lead a happy life.As for the protection, I analyze the jurisprudence basis of it. From the perspective of human right, the meaning of labor is explained; from the perspective of fair, the significance of fairly allocating the social property is clarified. That is to say, paying enough attention to laborers means great progress to the society.At last, making a description of future labor tendency is necessary. It is a tendency that the standards of protecting labors are connected with trade. With the development of economy and society, the level of protecting laborers will become higher and higher. So they can enjoy the benefits of development of world.
