The problems of labor’s right become more and more valued after the economic globalization, and the International labor standards started to refer to so many countries. The international labor standards also began to be related to the international trade, so that the international labor standards could influenced on international trade and even international trade direction. As a big country, one of the members of WTO, nowadays has become a great commercial country with supreme labor number and the greatest labor market in the world, so that the labor standards issue cannot be ignored. China relying on international trade, owns a large amount of cheap labors and mainly exports labor-intensive products to other countries. So the international labor standards being related to international trade has developed into a surely certain trend. The paper will based on the influences brought to the world by the international labor standards, and the influences brought to China’s international trade by the international labor standards. Of course, this trend will bring more and more influences on China’s international trade. And these influences will enlarge gradually as the international labor standards become more popular in China.This paper aims to analyze the influences brought to China’s international standards, and give some advices to the government and enterprise to encounter the influence brought by the international labor standards. Whether the problems of labor rights protection can be a good solution, largely determines the economic globalization will be go long term or not. This paper describes the time on labor rights are violated, we can solve by the legal solutions and other ways.So that we can better in-depth study of labor rights protection system. The paper point out the advices to our government and law about the international labor standards.The paper will be divided into four parts. The first part will briefly introduce the content and the relevant theoretical of international labor standards, and also the development of international labor standards and so on. In this paper, the status of the international labor rights protection will be analyzed at first. And this paper also explained the classification to contents of international labor standard by theory. The international labor rights will be a variety of certification of international standards, become a new trade barriers.The second part of the paper analysis when the labor rights have been infringed on the labor export can take the positive approach and measures. That divided into litigation and non-litigation dispute resolution ways.The third part is the description of the various countries for labor export legislation in the labor standards and labor rights protection system. The developed countries generally has higher working conditions, wages and benefits, with that, the protection of labor rights situation in developing countries is relatively backward, labor rights protection issues has become relatively prominent. But newly the developing countries have begun to formulate relevant laws and policies, and protect labor rights. After the international service dispute produces, most of countries processing touches on foreign affairs the service dispute by private international law rule. Along with the international service trade development, the ways to solve dispute become diversification.The fourth part describes the protection of labor rights and the relevant provisions of the relevant legislation of our country, and to propose legislative measures and recommendations should be taken. China also extremely lags in the foreign labor service cooperation legislation aspect, until now has not formulated about this aspect legal law and legislation, this inevitably will create our country the aspect which will appear in the external assignment services aspect is unable to be depend on, finally will hinder the foreign labor services exporting the development. On this basis, the paper proposes some advices to foreign labor export, hoping to protect the legitimate rights of foreign labor better.
