| Construction projects supervisory system in our country has a short history:in1988started the experiment site, in1992officially promoted, in1997promulgated " People’s Republic of China Construction Law" the fourth chapter of unique seal establishment "architectural engineering supervisory ", thus truly bought into line with construction projects supervisory to in the legal system frame. More than two decade’s of development, the establishment of construction supervisory system has matured, it has played an extremely important effect on controlling time limit of projects, improving project quality and controlling investment. The supervisory system has become an indispensable factor to promote the development of construction industry.However, with the further segmentation and development of engineering construction market, the deficiency of supervision system and the legislation have become ever more salient, such as the obscure supervision positioning and ambiguous function and power, the coexistence of contradictive laws and regulations as well as the substantial risks of security and responsibility of supervision. This paper mainly conducts analysis and researches on these key issues existing in the supervision system and proposes three suggestions by taking into account the real-life experience: first, it is necessary to reintroduce the legislation into the function and power of supervisors for the purpose of giving prominence to the legal status of supervisor as the independent third party and improving the legislative system of rules and regulations; second, it is essential to introduce the risk management system so as to cut off the clientage between supervisors and proprietors and guarantee the justice and independence of the functions and powers of supervisors; last, it is advisable to adopt the universal professional liability insurance system of the supervisors to avoid the legal and liability risks, which could make the supervision system more rational. |
