The Function And Function Of Dali Temple In The Judicial Practice In Qing Dynasty

San Fasi is the most important judicial adjudication system of the central government in Qing Dynasty. It plays an important role in the development of its judicial system and the whole feudal judicial system. This thesis will focus on the role and function of Dali Temple subordinating to San Fasi. The analysis will contribute to the further understanding of the organization--Dali Temple and make people keep to the subject in practice.Section One will briefly introduce the historical development of Dali Temple. It is divided into two periods, before and after Ming Dynasty and Qing Dynasty, based on its function and role in the judicial system. Then, it will make a basic comparison between the Dali Temple in Ming Dynasty and in Qing Dynasty. The differences are the key point including the institutional establishment, factors disturbing judicial system and the power change in the Board of Punishment.Section Two will discuss Dali Temple and rules of etiquette. This section will explore the presentation of traditional Chinese rules of etiquette in Dali Temple based on the name of Dali Temple, the official’s legal quality and some practical activities.Section Three is the main part of this thesis focusing on the role of Dali Temple in judicial practice. Firstly, it will describe the judicial procedure and analyze the power division of this organization based on two laws. Secondly, it will analyze the judicial cases of Dali Temple according to some other trial cases and samples. These cases are divided into two parts. The cases which are well negotiated in San Fasi are the first part. The second part means disagreement between Dali Temple, Board of Punishment and Court of Censors, which are the main discussed point. People can see the role of Dali Temple from the second kind of cases. Thirdly, Dali Temple participates in the modification of rules. It can report to the throne for modification when it appears some inappropriate situations in the process of carrying out the rules. Section two pays more attention to cases through which people can see the relation between Dali Temple, Board of Punishment and Court of Censors and also can see the Emperor’s decisive power in judicial practice.Section Four will analyze the mutual constraint in the feudal capability mechanism. People will have a better understanding of the whole feudal administrative system’s operation.Section Five will make a summary and further analyze the real function and role of Dali Temple in judicial practice,Through discussion of these parts, We can have a more comprehensive understanding and knowledge of the function and role of the Qing Dynasty in the Dali Temple of the judicial practice.
