An Analysis Of Some Legal Problems In Network Group Purchase In China

From the early21st century, Online buying in group has been gradually penetrating into people’s daily life and challenging the developed ideas of trade. With the rapid development of the internet and increasing demand of online shopping, the online group-buying has established its booming market in our country. However the disadvantages of it become more and more manifest in recent years, such as lacking regulations, fraudulence, difficulties of defending, all of them can make great harm to the health of this trending. This paper, based on the analysis of the status of online group-buying, points out some problems existing in this new mode and proposes some measures and suggestions to strengthen the supervision regulations and supervisions of online group-buying market, so as to promote its healthy and orderly development.This paper includes three parts:introduction, body, and conclusion. The introduction part mainly explains the background and significance, reviews on domestic and overseas research status. The body part has four sections to study the online group-purchasing in our country. Chapter1summarizes the online group-buying, mainly discusses its conception, characters, business model. Chapter2analyses the subjects of online group-buying and their legal relationships in different models based on Chapter1. Chapter3involves the analysis of all aspects of online group-buying contract, such as its validity, performance, and the grounds of relief for its subjects. In view of existent problems in consumers’ interest protection law of our country, the last chapter puts forward the corresponding suggestions on how to perfect its regulations and mechanisms.
