| Punishments for public order and security administration, one kind of administrative act in public security, is the administrative punishment for lawbreakers who don’t break the criminal law, to deprive their personal freedom, property or other administrative punishments of right according to law by public security organ.Law of the People’s Republic of China on punishments in public order and security administration is a major legal basis for the public security organs to implement the public security management and punishments in public order and security administration. Its enactment and enforcement has important significance in maintaining stable social public security order and promoting social harmony. However, there is still much unsatisfactory in its process system and the subject of law enforcement.According to the legal theory concerning punishments in public order and security administration, from the study of the current legal system to start, this paper discusses cohesion and conflict problems between law of punishments in public order and security administration and other related laws to advance relevant appropriate solutions, and analyzes the problems about its entity, process and implementation so as to put forward some strategic suggestions to perfect the law.This article consists of four chapters.Chapter1:Mainly discusses the related the concepts, theories, legal system, basic principle and basic system of punishments in public order and security administration, building the theoretical framework of the paper.Chapter2:Study and investigate the legal system of public security punishments at home and abroad.Chapter3:Discussed the cohesion and conflict problems between the law of punishments in public order and security administration and other related laws so as to propose some solution ways.Chapter4:Analyze existing problems of punishments in public order and security administration in our country and put forward some strategic suggestions to perfect the law. |
