On The Protection Of College Students' Right To Privacy

In recent years, with the increasing of college enrollment, college students of this special group are growing. As an important force in China’s modernization, the future life of college students, learning, and the healthy development of body and mind need to get special attention, from the perspective of legal protection, is their legal rights and interests should be practical and security. But the fact is on the contrary, during the college education, often occur the phenomenon of infringement of privacy of university students, and students’right of privacy have no effective remedy violations to save in case of it’s in danger, causing the the relationship between college students and the colleges is increasingly tense. Delve into its original, both college students particularity of original privacy itself,and the relevant laws and regulations on university students ’right of privacy is blank, in adittion,the management system of colleges and universities is not perfect. Therefore, this article attempts through to the definition of university students’ right of privacy, the reason behind the excavation of the university students’ privacy is being violated, and combined with the existing research results and the actual condition of our university, to discusse and put forward concrete countermeasures and suggestions to save the college students’ privacy.This paper will be divided into five parts:The first part, introducting writing background, purpose and significance of this article, the research current situation analysis and the research mentality and method.The second part, mainly analyzing definition of university students’ right of privacy, through the analysis of the concept of university students’ right of privacy, combining with the particularity of university students’ right of privacy, and the limitation of university students’ right of privacy, and then to define the university students’ right of privacy.The third part is an introduction to university students’ right of privacy is being violated four cases.such as violation of university students’ right of privacy is highlighted in the student dormitory management, student rewards and punishments and information management, and funding for poor students four aspects.The fourth part, exploring the reasons of our country university students’ privacy is being violated. Reason mainly includes the management of colleges and universities, students’ right to know and privacy rights conflict, the traditional education idea and the imperfect management system in colleges and universities, and students’ legal consciousness and the student rights relief channels of a single.The fifth part, combining with the actual situation in our country, combining with the above analysis, the reason for the university students’ privacy is being violated puts forward concrete countermeasures and suggestions of the privacy protection of university students. Mainly divided into balance conflict between university and student rights through legislation, updating the education idea and perfect management system of colleges and universities, and improving students’ right of privacy protection awareness and establishing a mechanism of right remedy for college students.
