The Theoretical Basis And Practice Of Procuratorial Credibility

This paper firstly defines the concept of the procuratorial credibility, and furtherexamines the differences between this concept and the definitions of credibility andprocuratorial credibility. Based on such a study, it is believed that, for the purpose ofbuilding up a well-equipped procuratorial system, improving the profession of theprosecutor, guaranteeing the independence of the procuratorial organ and raising therecognition level of the procuratorate decisions，the authority of the procuratorial power，the satisfaction of the public and the level of the justice need to be included in thevaluation criteria of the procuratorial credibility. With a comprehensive analysis of thelegal statues of the procuratorial credibility in China, this paper points out twelve existingproblems including the undeveloped implementation system, the lack of a supervisionsystem and the ultra vires of the media power. Finally, the paper proposes a solution toconsummate the procuratorial credibility via defending the constitutional rights, settingup a developed operating mechanism of the procuratorial authority and improvingthe predisposition of procurator.
