Collective ownership is the institution in the rural land in our country, and the ownershipof the rural land is exercised by the rural collective economic organizations. Withurbanization, a large number of rural lands are expropriated. While in China rural landexpropriation is a "unification" compensation system, land compensation is rural collectiveland compensation for the change of ownership. In the collective internal distribution, the"non-traditional villagers" are often considered to have no collective membership andexcluded, which is the main reason why currently allocated land compensation disputesincreasing. The membership is not only related to the allocation of rights to land acquisitioncompensation fee, but also related to the use to the homestead, the rural land contract, theinterest in the collective assets, major issues involved in collective decision-making and manyother capabilities. Therefore, to determine the membership of the rural collective economicorganizations is a matter of basic survival for the farmers, and also is the foundation of sociallife in rural areas. It is significant for the majority of farmers.Collective economic organizations membership recognition system includes members ofthe collective economic organization recognized standards, procedures, identified body and soon. This paper only discusses the collective economic organizations membership standard,starting from the collective economic organization history and characteristics, analyzing theconnotation of the collective economic organization members. The author will analyze thecollective economic organizations membership qualification criteria in the judicial practicedialectically, looking forward to finally being able to figure out the reasonable standards. Thatincludes the principle that identify rural collective economic organizations membershipshould follow, factor, membership acquisition and loss, members of particular groups thatqualification should be considered. Under the existing national protection and stable ruralland contract relations policy, it is important to have a correct understanding of therelationship between the membership and the right to operate the rural household landcontract in the judicial practice on the correct identification of collective economicorganizations membership.
