Study On The Establishment Of Patent Forewarning System Of Enterprises

In these years, the number of patent infringement affairs of enterprises has shown obviously ascending trend, which has affected enterprises' survival and development and country's economic security. So we must take forewarning and forecontroling research on enterprises' patent infringement crises. At the present time, the study on enterprise's patent forewarning has just appeared. There is hardly academic and methodological research on how to establish enterprise's patent forewarning system. What the paper do is to establish enterprise own patent forewarning system from the angle of enterprise, including the system's organization institution, operational system, patent forewarning degree evaluation means, countermeasures and so on. By researching this, this study has not only theory value but also has reality significance to the enterprise's management practice.This paper firstly advances the conception of enterprise's patent forewarning. Under the direction of this conception, the paper discusses the composing constituents and functions, expounds the principles and aims of establishing patent forewarning system in enterprise, and analyses the system's operation contents, namely forewarning analysis and forecontroling countermeasures. And then from the angle of enterprise organization and utilizing enterprise forewarning management theory, the paper analyses the organization institutions' functions and relations in the system, and on this base, the paper works out five kinds of basic patterns of organization institution.The paper further points out the operational mode of the patent forewarning systemwhich include the patent forewarning system's operational subsystems, the operational flow of the system, the tactic systems and human resource collocation. Subsequently, utilizing qualitative evaluation means and referring to the rules of judging patent infringement and symptoms of risks of patent infringement, the paper establishes patent forewarning degree qualitative evaluation index system and elementarily discusses the quantitative evaluation index. On the foundation of means of enterprise's patent management and under the direction of principles of enterprise's patent forewarning management, the paper discusses patent forewarning management counterrneasures.At last, on the base of present organization structure of DongFang Electrical Machinery CO. LTD, the paper establishes its organization of patent forewarning system, and by using the system, the paper analyses the case of managing patent infringement crises.The academic and methodological researches on enterprise's patent forewarning management have just appeared. On the above studies, the paper take elementary studies on establishing patent forewarning system within enterprise and educes material mode. The paper tries to fill in the gaps of this research field. The aims of this paper are to provide reference value and direction function for enterprises to obtain competition dominance on patent, to keep away and control risks of patent infringement, to improve abilities of handling patent infringement crises.
