Telecommunication Regulation Reform: Theory Foundation, International Experience And Rebuilding Our Modern System

The telecommunication regulations reform is our country's important task to be in the face of global economy and the WTO, and to deepen the market economic structural reform in the field of basic establishment. The author estimates briefly the basic theories of the modern economy regulations, analyzes and compares the characters of the telecommunication regulations system among different countries, reviews the history of our country's telecommunication regulations reform and comments on the reform's effect. On the above basis, the author brings up the concrete thoughts and the suggestions for reconstructing and consummating our country's telecommunication regulations reform.The author considers that the developing direction of the modern economy regulations theories is turning from the dominant station of the governmental interference to the station of deregulating and improving the governmental regulations, and introducing the power in the market. It is the essential of the regulations reform that we should adjust the regulations system to adapt the changeful relations between the government and the market. Using the main practice of different countries' telecommunication regulations reform for reference, we should apply the beneficial experiences of abiding the "legislation ahead" principle and insuring the independency and neutrality of the regulations organization.Furthermore, we should combine the above experiences with our characteristics in the interim, making the market power act in the regulated field and promoting governmental regulations reform synchronously. Reviewing the practice of our telecommunication regulations reform, though we have biggish improvements in it, we still have some problems unsolved, such as deficient independency of the regulations organization, delay of the regulations law, inadequate recognition to the consumers' welfare, effective competitions unredeemed, incomplete telecommunication universal service, and so on. It is the essential reason that the called gradual reform must result in the incompletion of our telecommunication regulations reform consequentially, which must induce the conflicts between the exterior rules and the interior rules in our reform farther. Therefore, we should take these following measures in rebuilding and consummating our telecommunication regulations system: perfecting the regulations for the independency and neutrality of the regulation organization, implementing the effective competitions policy, introducing the stimulative price strategy and regulations policy of the coadjacent meshwork, crating advantages for our telecommunication companies in their internationalization management in the course of expanding opening to the outside world, and so forth. Different from the others' research visual angle of making concrete suggestions, including the policy of the access permission, the price and the coadjacent meshwork regulations, the author deems that the most important task in our future telecommunication regulations reform is collocating the power rationally and enhancing the management of the regulation organization. Furthermore, the author seems that we put superabundant recognition on the -formal innovation and neglect to the essential innovation, in the former period of our reform. In the end, the author emphasizes the essentiality of recasting and investing to our telecommunication industry's current human capital, which could insure the victory of the reform.
