With the rise of knowledge-based economy, the acceleration of world economic globalization, the further development of global trade liberalization and the increasing fierce market competition, the importance of intellectual property right (IPR) has been enhanced historically. The competition between businesses will mainly lie in IPR in the future. Since the 21^st century each country has established her own IPR strategies, which makes it popular to attach importance to IPR. Colleges and universities as scientific research teams have played a very prominent role in the national scientific research system reform. As the basis of national intellectual innovation and the cradle of IPR, colleges and universities possess the largest share of IPR to a certain extent. Therefore, how to improve the IPR management is the subject needing researching and solving. At the same time, it is also a vital factor in inspiring the innovation enthusiasm for collegial scientific research staff.Being a kind of property relations, patent system is the most effective way to promote scientific innovation. In today's era, colleges and universities are the major fields of scientific innovation. The students and faculty are the main force of scientific research. Promulgating college patent management system is like pouring benefit oil to the scientific and technological frame, which has tremendous contribution to scientific research both in quantity and quality. In the era of knowledge-based economy, colleges and universities in our country have gradually set up development as a constructing aim. Currently with the implementation of scientific research-oriented university activity, establishing college patent system attracts increasing attention from various colleges and universities. Some universities have already formulated the patent management system. The promotional role of the collegial patent management system to the innovative activities in college has already been noticed (under the stimulus of this system, the quantity of collegial patent products have increased sharply).Establishing the patent management system has yet been an aim every college eagerly pursues.Nowadays, though favorable achievements have been made in the construction of collegial patent management system, there exist quite a few problems in this process, such as the ignorance of the importance of patent system, the monotony of patent management, the discrepancy between patent system and demand, the deficiency in patent management talents, the poor patent management technology etc. If these problems are not solved, it will influence the full play of collegial management system, the output of collegial patent technology and will inhibit the innovative enthusiasm and positivism of college technological innovation staff.Beginning with the description of the rise, development and evolvement of patent system, this thesis expounds on the connotation, content, value, theory and function of it respectively. Starting from the practices of representative countries, great attachment is paid to the comparative improvements made in collegial patent system from abroad especially USA and Japan, analyzing the content, policy, successful experience and failing lessons. This paper also puts emphasis on two aspects: on the one hand, it discusses how USA, Japan and other foreign countries tackle the possession of collegial patent rights. On the other hand, this thesis stresses on explaining how USA and Japan distribute recompenses after the implementation of collegial patent system. It aims at providing enlightenment for our colleges and universities so as to settle the problem of low rate implementation of patents. In the latter part of this thesis, the author compares the status quo of the construction of collegial patent system in our country with that of other countries. There can be no differentiation without contrast. In addition, this paper point out various kinds of insufficiencies existed in the construction and enforcement of our collegial patent management system. Finally, the author puts forward some suggestions on how to ameliorate the building and enforcement of collegial patent management system in our country.Collegial patent management system is a systematical project and it involves in numerous profit bodies such as the body of collegial technological innovation, colleges and universities, each department, implementingmanagement bodies and so on. Hence, while implementing collegial patent management system we must balance the interests of various bodies and inspire the enthusiasms of technological innovation in various aspects. Accordingly, the construction and enforcement of collegial patent management system demands the enforcement of professional institutes and staff.
