In recent years, the tendency of technical complications brings out in some important technology fields, such as Electronic Communication, Network Communication and so on. Enterprises and products are inserted in complicated technology networks. The number of patents is exploding. Under this background, patent traps are springing up. They are rapidly extending and deeply spreading. Nowadays, Chinese economy is in the pivotal stage. Because of lacking experience, it is easy for Chinese enterprises to be caught in the surrounding of multitudinous patents. During the stage, they don’t only have to pay for the high cost of patent royalty, but also delay the process of R&D. Meanwhile, they are frequently suffered lawsuit and claims by inadvertently infringing certain technical patents. How to take methods to indentify patent traps is an urgent task. It is a new challenge for Chinese enterprises to effectively avoid patent traps and strive for independent innovation.Supported by the theories of patent quantitative analytical methods, this thesis uses methods of case study, statistical analysis and two dimensional analytical methods to identify patent traps. Firstly, through the analysis of research progress and typical case, we can summarize the characters of patent traps---the dense and overlapping of patents. Based on this summary, quantitative indexes are proposed. The indexes include the number of patents and patent density. And then, we build the analytical method and put forward the identification method. Finally, in order to verify the validity of this method, taking patents in American telecommunication as research sample, we use this method to identify possible field that coincidence with patent traps. On this basis, some suggestions are proposed.The descriptive statistical analysis shows that the distribution of patent assignees is disperse. However, those ranking the top are still famous enterprises. Through the cluster of patents, we can draw the patent map and see the technical developing trend. With the application of identification method, it is found that the H04L-transmission of digital information is the most possible field that coincidence with patent traps. What should be paid special attention are the H04W-wireless communication networks. Although there aren’t too many stocks of patents, it may be the severely afflicted area of patent traps in the future due to the rapid progress of wireless technology.
