The Study On Technical Barriers To Trade Based On Technical Standard

Since the multilateral trade system has been operated for 50 years, along with the continuous acceleration of the process of economy globalization and trade liberalization, the traditional trade barriers such as customs duty, quota and license are continuously weakened. While ,at the same time the new trade protection measures with technical trade barriers as its main method are increasingly popular. China, as a big trading country, is inevitably to be confronted with the technical barriers to trade problems in the course of trade development.Actually, as the third largest export country(in 2004), our efforts to expand export output have been influenced by the technical trade barriers of foreign countries, on the other hand, due to the lack of a perfect and complete technical trade barrier system, the domestic market is out of effective protection which results in a great deal of products coming into our country by means of trading. However, these products are always produced in low levels or under the demand of technical rules and standards. Moreover, these two aspects will become more fierce along with the strengthening of the technical trade barrier of various countries and easy access to Chinese market, but concerned study is mostly confined to trade theories and policies, yet overlook the technical standards and other social, economic and technical theories and their use in this fields.Therefore, based on the above background, according to train of thought of how to cross over foreign TBT(Technical Barriers to Trade) and construct our own complete TBT protection system, with the basis of economic theories, and aiming to the unique conditions of TBT of our country, using the methods of countermeasure, comparative study and case research this paper undertake the research on how China should do to break through TBT.This paper pays more attention to relevant basic theories and concepts in the part of theory, and uses theory tools such as profits to increase progressively theory, property right theory and trade protection theory to summarize and innovate the mechanism of how technical standards form TBT. Then, in the light of the practice of the foreign trade of our country, using themethods of comparative analysis and case analysis to analyze the impact drawn upon by TBT to our import and export trade, the paper points out that the source of all the problems lies in the technical standards. However, most our national standards lag behind the international level, only very few technical standards get their admitted by international market. The products manufactured according to Chinese technical standards have little added value, which is the very question of our technical standards. On the base of above analysis, dealing with the mechanism of how technical standards form TBT, the paper puts out the advice of realizing standard strategy, and also gives advice on the problems such as how to implement standardized strategy, how to use strategic thought to avoid risk when implementing standardized strategy, and how to carry on the tactics choice of technological innovation.
