Electronics is a product of modern information technology, and the electronic waste is growing at an alarming rate, in today’s society of information technology rapid development. The booming electronic products, immediately become e-waste, after the elimination, occupy our living space, seriously affecting the environmental safety and human health. At the same time, the e-waste contains rich metal resources and other resources, if carry on the recycling scientifically, the resources included can be collected, which can reduce the resource shortage problem. Therefore, it’s becoming the hot topics, that how to treat e-waste correctly, avoid damage to the environment and recycling e-waste efficiently. This article provides suggestions of our country’s perfecting of e-waste recycling law, after the research of China’s legal regulation about e-waste recycling and borrowed the foreign advanced experiences, based on this background. The structure of this paper is divided into four parts:The first part discusses the basic problem of e-waste in detail, including the theoretical basis of e-wastes’concept, hazard and recycling, and laid a theoretical foundation to perfect the legal regulation of the e-waste;The second part summarizes the China’s legal development of the e-waste recycling, then analyses the problems existing in the extant legal system, points out that the lack of comprehensive and concreteness, the deficiency and mandatory of law, make clear the object of our country law;The third part introducing the advanced experience of foreign e-waste recycling, focus on Japan, the United States, the European Union, summarizes the enlightenment to our country, which is used for reference of perfecting our country law;The fourth part is the key chapter of this paper, the synthesis of former three parts. It aimed at the deficiency of legal regulation in our country, combining the reality in our country, draw lessons from foreign advanced experience, put forward some humble opinion to perfect our country’s e-waste recycling law regulation system, to promote the e-waste recycling.
