The obvious emergence of problems that result from waste electrical and electronic equipments has the close relationship with the level of economic development in countries or areas. The experiences of developed countries or areas make clear that as long as the production and consumption of electrical and electronic equipments are creasing, the management of WEEE is inevitable and necessary.With advanced environmental protection policies and laws,The European Union established environmental pioneer image in the world, has established a relatively perfect waste management legal system, especially the "WEEE Directive" and "RoHS Directive" and "EuP Directive" is popular worldwide and achieved good effect in practice.This is not only for its member states provides the electronic waste management a systematic and comprehensive legal framework, but also provide a beneficial reference and enlightenment for other countries and regions.Firstly, this paper summarizes the related issues of electronic waste, e-waste has the harmfulness and renewable value double characteristics determines the proper management of the electronic waste, so as to achieve the purpose of protect environment and conserve resources. The EU environmental law embodies the integration principle, the intergrated pollution control principle,the precautionary principle and polluter pays principle, specific to the waste management, it fully embodies the classified collection principle, the nearest disposal principle and the extended producer responsibility principle.In the electronic waste legislation, establishing the waste hierarchical management system, eco-design system, the pre-paid system, deal with censorship and information disclosure system, these are the important cornerstone of electronic waste effective management in EU.However, it should noticed that China and the EU in the nature of society, economic structure and cultural background there are significant differences, learn from the EU experience must be emphasized that science and rationality, can not be directly applied to the model of EU. Based on this, this paper on the basis of the deeply analyses of the EU electronic waste legislation, through the legislation status quo and existing problems of electronic waste management in China, learn the experience from the EU,and based on China’s national conditions, in order to impove China’s electronic waste management legislation, safeguard Chinese international trade benefits, put forward my own suggestions.The predecessors of the existing research results, both of China and the European Union the systematic study of the legal issues related to electronic waste, or focus on a certain angle, has a higher academic value, give the inspiration to the author. Based on the previous studies, this paper attempt to innovate in the following aspects:First, combing the EU environmental legal system, focus on translated the relevant EU electronic waste directives and latest revision, review the legislative background, basic principles and main terms; Secondly, combined with the EU experience, focusing on the scope of application of the law of electronic waste management, recycling and the legal responsibility, etc, express my personal new ideas, trying to make some useful exploration for the perfect Chinese e-waste management laws.
