Research On Ecological Damage Compensation Caused By Oil Spill

In recent years, the social and economic activities of human beings more and more impact on marine ecological security and environmental quality, marine and coastal waters around the world is experiencing an unprecedented ecological challenges. The Oceans belongs to the category of public resources, but the marine ecosystem has properties of public goods. Because China has not yet established a sound ecological damage compensation mechanism caused by spilled oil, resulting in the destruction of the marine environment can still not get the corresponding compensation effectively. Therefore, in this article, we point out that these issues are "compensation standards","the main object of compensation" and "How to implement damages" about the theory of marine oil spill ecological damage compensation. The research object of the paper is the oil spill event on July16in Dalian. Through theoretical analysis and empirical analysis of this incident, we draw specific embodiments of marine oil spill ecological damages about this incident.Firstly, in this paper we defined the research content of the marine oil spill environmental damage, and take the value assessment on the three aspects of the recovering project cost, restoration project and the clean-up cost on marine oil spills ecological damage. We take the spill event on July16in Dalian as the research background, and estimated that the loss of Marine environmental capacity is3.09billion, the loss of Marine ecosystem services function is5.9536million and the ecological environment Compensation renovation costs90.926million. So the cost of restoration project is424million. In the restore project after Marine oil spill, we think the service period of this protected area is20years, and need to build the marine ecological reserve whose scale is71.91km2to achieve the initial level. Through data statistics the clean-up cost can be1.168billion. It follows that the losses of ecological damage caused by this oil spill is1.592billion. The magnitude of value about marine oil spill ecological damage by can be the basis of compensation standard about marine oil spill ecological damages compensation, and is also the minimum of ecological damage compensation. By analyzing the game relationship among stakeholders about marine oil spills ecological damage compensation, we expand the scope of the research on compensation bodies and compensation objects. Compensation bodies are Hui Shengda company, Xiang Cheng company and China National Petroleum Corporation result in Dalian7.16events. Compensation objects are local governments, farmers and seafood processing enterprises and so on. This study provides a reference to the range of bodies and objects of ecological accident damages.Finally, through the above theoretical research and empirical analysis, we determine compensation subject, compensation object and compensation standards in the marine ecological damage compensation policy. Thereby we construct the relationship diagram between compensation policy and compensation object. Hui Shengda company, Xiang Cheng company and China National Petroleum Corporation which are the main responsibility should compensate for the losses of local governments, farmers and seafood processing enterprises, and should compensate and restore for surrounding ecological environmental damage. They should make more than6.079billion on financial indemnity, and make more than1.592billion the ecological environment compensation. These compensations should be compensated by the government combined with market-based instruments. This provides a theoretical basis for the establishment of marine ecological damages Policy.
