Research On Effective Utilization Of Transfer Payment Funds In Politics And Law's Departments

This paper, taking procuratorate system for an example, based on carding the related theories on financial transfer payment methods, judicial independence and judicial justice, makes a comparative analysis about the utilization situation of financial transfer payment funds in the procuratorial funds guarantee of China's different regions The paper discusses how to use the financial transfer payment funds scientifically and long-term effectively, and especially in the different economic foundation and judicial environment of China's east and Midwest regions, how to allocate and use fiscal transfer payment reasonably to realize the balanced development of the procuratorial work.The first part introduces the research background and significance with the literature of transfer payment funds in politics and law's departments at home and abroad reviewed. The second part, through analyzing the theoretical and practical basis of effective utilization of politics and law's departments'transfer payment funds in the domestic and international procuratorial funds guarantee system, elaborates the reform's necessity of the procuratorial funds guarantee system.The third part, with the methods of comparative analysis and case study, makes a comparative analysis about the six provinces in eastern China and six provinces in Midwestern China, and analyzes five municipalities with independent planning status in eastern China respectively. The paper deeply discusses specific implementation problems in financial transfer payment of the procuratorate system, and how the procuratorial organs which emphasizing judicial independence improve the procuratorial funds safeguard level, construct effective mechanism of the procuratorial organs funds safeguard through the utilization of transfer payments fund.
