With the continuous development of the international petroleum and gas market, the international petroleum and gas cooperation is always accomplished by international petroleum and gas cooperative contracts, signed and implemented between the host country government of resources (or represented by national petroleum companies) and foreign petroleum companies. Therefore, a lot more attention with respect to this cooperative contract system is paid by the host country governments and national and foreign petroleum companies. The international petroleum and gas cooperative contract is a kind of legal contract made between the host country government of resources (or represented by national petroleum companies) and foreign petroleum companies for the purpose of cooperation in aspects of petroleum and gas exploration, production development and sales.By making analysis of the international petroleum and gas cooperative contract's the main contents, rights and obligations and examples of foreign host countries'contract types, This article aims to analyze advantages and disadvantages of the existing contract system in order to shed some light on the reform in China's petroleum and gas industry.This article includes five chapters.The first chapter mainly introduces the creation, definition, legal characteristics, functions and legal basis of international petroleum and gas cooperative contract.The second chapter analyzes definitions, characteristics, rights and obligations of Royalty contract, PSA, Service contract, Buy-Back contract, JVA and Special contract.The third chapter analyzes the main contents and terms of international petroleum and gas cooperative contract, including the ownership of mineral resources, the right of exploration and production, the tax system, and ways to obtain exclusive rights of exploration and production.The fourth chapter gives examples of representative countries such as Russia, Kazakhstan, Iran and Iraq by looking into their petroleum law, main content of terms, the types of petroleum and gas cooperative contract, and then takes some relative investment advice for foreign petroleum companies.The final chapter represents the current situation and the existing problem of China's cooperative contract, and then gives some suggestions for improvement.
