| With economic globalization and rapidly developed shipping industry, more sunken objects and environmental pollution problem became a world problem that all countries are trying to solve the problem. our coastal and inland river existing a certain amount of wreckage led by traffic accident, the existing equipment and technology was unable to salvage by nature of lane, another important reason is the capital cost of salvaging a sunken ship. As our commercial insurance or P&I club insurance in the existing mechanism exists huge defects:pay to be paid or pay first, lack of direct action and insurance coverage low-grade problems that the expenses cannot be implemented.At Nairobi the international maritime organization (IMO) in year of 2007 implemented 2007 Nairobi Wreck Removal Convention, its purpose is to provide a set of international rules and obligation to the party and ship owners on a sailing or environmental threat of harm to the ship when ship sinking, cargo damage. The convention on the most salient feature is the "compulsory insurance or economic guarantee " compulsory insurance or direct legal action, it is trying to legislate in the economic level to resolve the matter of the cost. How to solve the cost of wreckage removal in present mechanism is the core content in this paper. To establish an enforce liability insurance of wreckage removal in our country, establish security approach as additional financial guarantee, expand the scope of responsibility, etc.Combined with the main problems in salvage, this paper analysis the necessary of establihing the wreckage removal cost mechanism using decisions approach; then use the arbitration model to analysis the relationship of present players in salvaging a sunken ship, and find a Nash in the end; In order to better solve the problem, the fourth chapter analyses the game in our salvage market, introduce Bertrand models and Hotel ling models to solve such a high cost in salvaging, finally came to the establishment of a more open, free market and cancel the qualifications of the salvage unit as well as speed up the reform of technical measures and equipment. |
