In seeks for the compensating method for environmental pollution damage, many countries reach the consensus that the liability insurance of environmental pollution is one of the most effective measures to solve the problem.The author of this paper launches the research on the overseas liability insurance of environment as well as the existing liability insurance of environmental pollution home through comparison, induction and other research methods. The findings are the followings: The liability insurance of environmental pollution in China lacks institutionalization; the liability insurance of environmental pollution in China does not have the corresponding laws and regulations. We need to construct a system for liability insurance of environmental pollution which conforms to our national conditions. A possible way for Chinese government to establish a system for the liability insurance of environmental pollution is to adopt the pattern that the compulsory liability insurance and the random liability insurance unify. And a corresponding system should be built on insurance rate and claim management. It is compulsory for companies which produce hazardous substance or those build their factories in the areas sensitive to the environment to insure compulsory liability insurance. However, the random liability insurance of environmental pollution should take the form of the insurance fund. Except for those enterprises which must insure the compulsory liability insurance at first before they can insure the random liability insurance, enterprises can insure the random liability insurance voluntarily. It functions as a financial support to the compulsory liability insurance as well as the atonement for the insufficient compensation for damage.
