The labor conflicts in non-public enterprise and its solutions is not only a theory problem that the current academic has researched and should be further researched urgently, but also a real problem that must be solved in the process of building socialism with Chinese characteristics. Since the 16th CPC National Congress, China has entered a new period of building a moderately prosperous society. This is both a strategic opportunity of realizing rapid development and a period with a variety of social conflicts, especially labor conflicts in non-public enterprises. What are the causes of the labor conflicts in non-public enterprise? What forms have they appeared?What are their characteristics? How to handle the labor conflicts in non-public enterprise correctly? Thorough analyzing and studying these problems has important theoretical and practical significance for resolving contradictions among the people in new era to keep political stability and unity ,building a socialist harmonious society and mobilizing all positive factors to build socialism with Chinese characteristicsIn this paper I adhere to the dialectical and historical materialism as a guide, adhere to the basic principles of integrating theory with practice, combining macro thinking and micro-viewpoint, theoretical analysis and the fact evidence, drawing the research methods from economics, law, sociology, political science and management disciplines, beginning with a scientific evaluation of non-public enterprises and its development's important position and role in national economy , the important significance of resolving labor conflicts correctly, starting from the varieties of forms of labor conflicts in non-public enterprises , striking characteristics and the causes of labor disputes to conduct a comprehensive, detailed inspection on the status of non-public enterprises. Based on these, in this paper, I have a scientific judgment for the nature of non-public enterprise labor conflicts, and then put forward to the solutions to labor conflicts in non-public enterprises.Non-public enterprises have a important status and play an important role in our economical society, it is an important part of our socialist market economy, is important motive force of economic growth, is an important source of national revenue; is important channel for the use of foreign capital and introducing advanced technology and management experience, but also it is an important platform for expanding the employment of residents. The right solution to labor-management conflicts in non-public enterprises is an inevitable requirement to build a socialist harmonious society,; is an important part of maintaining the stable and unite political situation; is the objective needs of non-public enterprises and national economy's health development; is the common needs to protect the interests of both employers and employees.The labor conflicts in non-public enterprises have these features such as various performance forms, the striking contradiction about the interests, the significant industry and regional disparities, the employers have absolute dominance and family atmosphere is deep, standardized level is low. The current's labor conflicts in non-public enterprise, mainly are laborers'wages are low and are in arrears and docked seriously; working environment is poor, work for long hours and working intensity is big; signing labor contract's rate is low and its content is not standardized and can not be effectively implemented; Laborer social security's coverage is low; the case that personal rights of laborers are violated is serious. the main causes leading to labor disputes of non-public enterprises are: the personification of the performance of the capital and the labor conflict; inequality between employers and employees, the imbalance of their power; trade union organization is not perfect; the relevant laws and regulations are not complete, lack of effective protection of legitimate rights and interests of workers; lack of effective government intervention and intervention; lack of humane care in enterprises, culture construction is lagging behind.The labor conflicts in non-public enterprises are not against contradictions, and also different from the labor-management conflicts in capitalism, but a special manifestation of the contradictions among the people in the new era, so they can only be solved with democratic and peaceful methods. To solve the labor conflicts in non-public enterprises, the government should fully play the leading role; establish and improve relevant laws and regulations, increase publicity and law enforcement forces; effectively play the functions of trade union rights; improve workers'professional skills and rights awareness and promote the growth and development of the labor market; establish and improve the tripartite coordination mechanism, enhance the social responsibility of business owners; enrich workers'cultural life, and increase efforts to help workers in difficulties.
