With the development of the international division of labor and integration of world economy, as well as the extension of world protectionism in trade, rules of origin, gradually, step out from the function of judging the economy nationality of goods and become one of the powerful tools which is used by the developed countries to protect the economy benefits of their own countries under the system of WTO. Through the practice of rules of origin, the developed countries not only protected their own enterprises effectively, but also reached the purpose of restricting the import while bringing in techniques and capitals. Although the non-preferential rules of origin in China have been revised, the origin criterion is so low that it can neither protect domestic enterprises actively, nor benefit our export companies therefore impedes the healthy development of the foreign trade. Thus we try to analyze the mechanism of the origin rules by some related theory models, on the basis of which we will discuss present problems of our non-preferential rules of origin and bring up some policy suggestions to improve it.This essay consists of 5 chapters. In the first part, the writer gives a brief introduction about the background and meaning of the thesis first. Then the research situation both at home and abroad and the innovation of the thesis are put on. In the second part, the essay mainly discusses some concepts. It explains in detail the sorts of rules of origin and the origin criterions. Besides, the significance of the existence of rules of origin is described. The third part is about the theories of rules of origin. It introduces the background and conditions in which the rules of origin are transferred into tools of trade protection. Then the writer analyzes the mechanism of rules of origin through some former theory models at length and explains all kinds of protection methods of rules of origin referring to the practical experience abroad.
