Study On The Application Of FIDIC On Chinese Railway Construction

It has passed 28 years since the reform and opening-up. During this time, the scale of railway has been keeping a fast growth speed. In the future, there will be lots of projects to be built at the railway building market. Because of the integration of world economy and China's WTO entry, we should adjust Chinese economic system in line with the general practice. Chinese railway building market has to face the influx of the international contractor. It's the priod challedge Chinese engineering has to face.FIDIC contract is a common standard in the international building project which has the international authority. Every content of it is more perfect, reasonable and fair, like the right, duty, procedure and so on.In this article, it first introduces FIDIC organization and its compositon and development, second, it analyzes the disadvantage of Chinese demonstration version consulting FIDIC contract in some aspects,for example the engineer, the right and responsibility of the employer and contractor, the compensation and arbitration, risk in the contract insurance and assurance, and designated contractor the examination after the completion Contractor design works. At last, it also gives some sugessions on teh improvement of the standard Chinese railway building version.I provide some own ideas about the compilation of the standard contract version on railway building by analyzing some problems in the original demonstration version in this article.
