The Research On Anti-commercial Bribery In Government Procurement

Government procurement system is the one of management institution of public finance in market economic nations. Its reform began, from 1996, in some districts in our country. With the practicing during ten years, the scale of procurement has been expanded and the frame of the system has been formed, promoting the good use of the limited finances. It plays more important role in fair playing and increasing the quality of service, works and goods, amplifying international competitiveness of national supplier and so on.With more competition emerging in government procurement transaction,the number of commercial bribery has sharply increased. This paper begins with starting the basic concept of commercial bribery and the theory of government procurement. It synthetically investigates and analyses the current situation and reasons of commercial bribery in government procurement. Then it points out the harms of commercial bribery, which include destroying the competition order of market, wasting social resources, generating corruption and immorality phenomena, reducing the quality of government procurement. Further more this paper analyses the reasons. Through the analysis of the experience contributing to manage commercial bribery of government procurement in foreign country and combined the significance, this article emphatically discusses the countermeasures. Such as: enhancing the perfect law system of government procurement and anti - commercial bribery, strengthening internal surveillance to restrict the mechanism of government procurement, promoting the whole-process supervision, perfecting external supervisor, establishing long effect mechanism of anti-commercial bribery in government procurement.
