The Solving Mechanism Research On The Payment Default In The Construction Field

This paper studies about project payment default in the construction field , bases on the analysis the situation of project default in Chongqing province ,and analyses the social harm, economic and social reasons from it , then evaluates the actual three measures( enterprises,judicial,administrative intervention )of the project payment default in the construction field. On the base of the characters of the construction contract and implementation mechanism, using country theory and New Institutional Economics theory, this paper compares and analyses advantage and disadvantage among private slef-realization implementation mechanism,private as third party implementation mechanism and country as a third party implementation mechanism on construction contract. And then pointing out the executive-led is relative effective. On the base of it, further analyzing the new problems which aroused in the current work of solving project payment default and studying low efficiency of the system roots in the various policies which country introduces in the implementation.Then suggesting government should regulate their investment behavior, broaden financial channels to solve it from the source; the government should also strengthen the supervision of payment in construction projects , establish the national, unified standard, perfect reward and punishment management credit information mechanism, vigorously promote engineering bond system, enforce owners payment bond and contractors performance bond, give full play to the role of supervising system , contain the problem of unpaid in the construction process; government should achieve integration among project cost, completion acceptance, housing advance sale organic integration,improve legal system and contract disputes, increase the implementation of construction contract disputes and establish remedial system; It should also build a long-term mechanism to solve the problem of Project payment default in the construction field through enforcing self-discipline and enhancing risk awareness.
