Shandong Province To Solve The Field Of Construction Projects Arrears Research

Along with the development of economy in our country,we are making rapid progress in the Construction Industry. In recent years,the delinquent in the construction field has become seriously. The phenomenon of delinquent in the construction field has affected seriously the process of construction,destroyed the economic order and the credit condition in society,but also led to the question of construction enterprise defaulting builder wage. The Phenomenon of delinquent in the construction field influenced on the society tranquilization and has become asocial effects of pollution,it is the time to punish this behavior.This paper studies about project payment default in the construction field , bases on the analysis the situation of project default in Shandong province ,and analyses the social harm, economic and social reasons from it , then evaluates the actual two measures( judicial,administrative intervention )of the project payment default in the construction field. On the base of the characters of the construction contract and implementation mechanism, using country theory and New Institutional Economics theory, this paper compares and analyses advantage and disadvantage :private slef-realization implementation mechanism has no effect,private as third party implementation mechanism has little effect,country as a third party implementation mechanism on construction contract has effect. And then pointing out the executive-led is relative effective. On the base of it, further analyzing the new problems which aroused in the current work of solving project payment default and studying low efficiency of the system roots in the various policies which country introduces in the implementation. Comparatively analyzes the actual method (law measures, administrative measures) in dealing with the delinquent settlement in the construction field, put forward the proposal to set up a long-term mechanism about delinquent settlement in the construction field from four sides as: enhance the supervision about project funds, standardize actor's behavior, fasten the building market mechanism construction as well as establish an uniform credit rewards and punishment mechanism.The study about this Problem has important meaning for maintaining the benefit of building enterprises and builders,standardizing the order of construction market,improving the construction development healthily.
