Research On The Protection Of The Rights And Interests Of Labor Of Farmer Workers And Its Public Policies

The appearance of farmer workers community has made great contributions to our country's economic development, which can not be substituted; however,their legitimate rights and interests in politics, economy, society and culture and many aspects have been violated. In terms of the rights and interests of labor, which are closely linked with their survival, compared with what they have paid their rights and interests of labor which they should enjoy as laborers have been seriously violated in the aspects of job opportunity, labor payment, rest and holidays, and labor security and sanitation. What they have paid is greatly disproportionate to what they have got. This article mainly analyses the present situation of the injuries to farmer workers' rights and interests of labor and holds that many-faceted reasons attribute to the injuries to farmer workers' rights and interests of labor. Firstly, city and countryside dual division system which takes the household register system as its foundation is the basic systematic reason which causes injuries to farmer workers' rights and interests of labor and therefore this unreasonable system must be changed. Secondly, under the circumstance that the farmer worker laborer market has been formed, the capital compulsory labor weak pattern enables the employer to have the intense opportunism behavior tendency and often become the main body which infringes farmer workers' rights and interests. Thirdly, The central authorities has laid the systematic foundation for the protection of the community's rights and interests through formulating and adjusting public policies, but while the central authorities' policies are unceasingly improved, there is the execution obstruct in the implementation of the public policies in local authority actually as a result of the benefit orientation, which causes the heartless infringement to farmer workers' rights and interests of labor .In view of the above reasons, from the angle of the execution of public policy, this article analyzes the experience of protecting the international laborers and firstly proposes there should be peasants' angle of view in the value orientation of public policies, namely formulating fair public policies to enable peasants which occupy the vast majority of population to equally share the achievements of social economic development. And secondly the local authority must strictly enforce the law in the policy execution, and gives severe attacks to all kinds of violation of farmer workers' rights and interests. Finally, from the angle of the formulation and execution of public policies, this article proposes related system vicissitude and consummation should be impelled to safeguard farmer workers' rights and interests of labor.
