A Study On The Protection Of Migrant Workers' Labor Rights And Interests

Migrant workers as a special product of the Constitution in two, belong to a special group of workers. They come from rural areas, with rural household registration, but living in the city; they are engaged in non-agricultural company, but not completely is the citizen, the labor relations is special. Because of its special nature of employment group, there are different from the normal city staff qualities. At present, the social status of migrant workers generally poor, and the labor rights protection project is relatively lack, not from the true sense of the overall maintenance of migrant workers’ legitimate rights and interests, we must according to the particularity of the employment of migrant workers groups, dig its guarantee of the rights and interests of reason items missing, according to the specific actual situation to formulate a feasible suggestions.The first chapter of this paper first introduces the purpose and significance, put forward the question and background, summarize the literature review of domestic scholars in recent years for the rights and interests of migrant workers. The second chapter is to defined migrant workers the scope, listed the main characteristics of its unique properties and their workers and analyzed the reasons of the migrant workers produce from their consciousness level and the social level, to lay a solid theoretical foundation for the future discussion. The third chapter through the Maslow’s hierarchy of needs theory, further analyzed the main motivation of migrant peasant workers and lists the social effect from two aspects of positive and negative. The forth chapter analyses the lack of protection of the migrant workers in four aspects that the social insurance, labor rights and interests, left behind children, social assistance,after that describes the lack of migrant workers labor rights protection may have consequences,for alarming the people to perfect the rights system. The fifth chapter introduces the reference system of security rights of migrant workers, improve from two aspects of foreign and domestic item. The sixth according to the above chapters, lists on perfecting the labor protection of migrant workers rights opinions. To the end, accomplished the whole chapter, we give some conclusion.The number of migrant workers groups in China is huge, and has reached 20% of the total population, if the protection of labor rights and interests of migrant workers is cannot be resolved, the social stability always exists a threat, we must pay enough attention to this problem, in order to protect the legitimate rights and interests of the grassroots labor.
