Research On Legal Environment For The Development Of Regional Economy

Market economy is,in fact,legal economy.Economic development and social progress is closely associated with sound legal environment which can greatly guarantee and boost economic prosperity and overall social progress.Reinforcing economic and legal construction is put forward in the Third Plenary Session of the 16th Central Committee of the Chinese Communist Party,the core of which is to establish systems,standardize power and responsibility,safeguard the rights and interests,and consequently to realize fast and good development of economic construction by strengthening economic legislation.Modern regional economy is a market economy where level of socialization is increasingly intensifying.Because there are the fields where the functions of market distribution of resources fail,the provision of public goods could not be delivered completely to the specified economic zones,the standardization in the regional economic order and many problems in the operation of regional economy need to be solved by the lawful and effective government intervention which is mainly embodied in providing sound legal environment,promoting regional legal quality by government administrative and legal means such as administration according to law, shifting functions,power restraint,standardization of policy-making,etc.to create excellent social environment for the development of regional economy and to improve the core-competitiveness of the regional economy.A lot of beneficial pursuits,good results and experiences have been made in the Development of the West Regions,revitalizing the North-eastern economy and in many coastal areas and cities such as Shanghai,Dalian,Ningbo etc.for providing sound and legal environment and developing regional economy.Meanwhile,in the academia,there are many theoretical investigations on the development of regional economy and regional legislation.I choose Study on Legal Environment for Regional Economy as the topic required by my supervisor,with the healthiness and perfection of legal environment as the breakthrough point,applying the principles and methods of regional economy to investigate the internal relationship between legal environment and economic development.The thesis falls into five chapters:Chapter One deals with the elementary theory of regional economic development and legal environment and the various contemporary academic articles on regional economic development and legal environment.The thesis expounds on the elementary theory of regional economic development and legal environment and defines the relevant concepts according to the requirements of the thesis.Chapter Two is about the theoretical analysis related to regional economic development and legal environment.Starting from "market economy is actually legal economy",we find out the good experience by analyzing the successful cases for regional economic development in the foreign countries,that is,mainly by increasing legislation,administrating according to law strictly,having sound legal systems,etc. to demonstrate the influences and roles that sound legal environment plays on the development of regional economy.Chapter Three explores the current legal environment for the regional economic development in our country:this chapter gives a general overview of the present situation of the regional development in our country,and points out the main problems in the development of regional economy from the defects in legislation, judicature,enforcement,legal supervision,conflicts of regional interests in the law, etc.Chapter Four analyzes the economic development in the north coastal areas of Weifang:the chapter points out the main present situation of the legal environment in the regional economic development in our country,and elaborates on the key measures of perfecting the legal environment by Weifang government in developing the economy,especially in the north economy,and then takes the development of north coastal areas as an example,pointing out the problems in the current development.Chapter Five discusses the suggestions and countermeasures in the perfection of the legal environment for regional economic development:the specific measures and methods to perfect the legal environment for regional economic development are put forward from the aspects of establishing legal and cultural environment,perfecting the legislative systems,administrating according to the law,impartial judicature and legal government.The thesis first puts forward the problem,and then analyzes and solves it.Based on the relatively sufficient analysis of the successful experiences of the regional economic development in the foreign countries and the problems in the current regional economic development in our country,taking north coastal areas in Weifang as an example,the thesis investigates the relationship between regional economic development and legal environment,and puts forward the main ideas and has a keen awareness in the following aspects:sound legal environment is the intrinsic factor of the regional economic development;the development of regional economy is closely associated with sound legal system,and must be guaranteed by the systems and measures from legislation,judicature,enforcement,etc.;the necessary conditions to boost regional economic development are a stable and order social environment, reasonable and efficient competitive environment,good credit environment and so on, among which,the transition of government ideas and enforcement pattern are the braking factors and fundamental guarantees for perfecting legal environment and accelerating regional economic development.
