Violence happened frequently in administrating roadside stalls impacts seriously on the stability and harmony of the society, which is a damage to the government's image and against the construction of our socialist harmonious society. Therefore the analysis and research on how to solve this problem has become imperative.This thesis analyses the causes of roadside stall business as well as the composition of the members who engage in such business. The laid-off workers, the unemployed and migrant workers are the main members of roadside stall business. More and more unemployed people becoming vendors, people's demands for consumption, low transaction costs, the fair trade market's being unable to meet people's needs and vendors'economic interests are the main causes of roadside stall business.There are some limitations of the administrative measures taken in our country, which can't be able to remove the causes foundamentally. By analysing the opposites of the contradiction the author finds that law enforcement officers in the department of urban management, vendors, local governments and sluggish legal relief channel are the direct or indirect causes leading to violence and therefore puts forward the following measures and suggestions: to establish a people-centered concept; to respond positively to roadside stall business in public policies; to change enforcement approach; to promote public participation; to smooth legal relief channel; to perfect the supervising mechanism in the department of urban management; to select policemen to cooperate with urban management enforcement. Setting up temperory service stations to provide convenience for people, planning the construction of fair trade markets, establishing an industry organization for vendors and make it play its role in helping vendors with self-discipline, right protection and communication and promoting the socialization of functions of adminitrative departments are the keys to solving the problem of violence, which are also four important new issues.In this thesis roadside stall business is considered not only a problem of city management but also a problem of the people's livelihood. Its positive externalities is more than its negative externalities, so the government should remove its negative externalities and protect its positive externalities. In addition, the government should also differentiate the behavior of vendors' illegally occupying the main roads of a city in their business from business itself. On one hand, try to guide and norm their illegal behavior of occupation, on the other hand, do everyting possible to support, encourage and protect business itself to meet vendors' demands for operating their business and the citizens'demands for consumption, protect environment and maintain traffic order of the city.The contradiction between vendors'right to life and public interests like city environment and traffic order etc. is regarded as the main contradiction in this paper. The minor contradictions are as follows: the contradiction between law enforcement officers in city management department and vendors due to illegal law enforcement; the contradiction between interest aspirations and sluggish right safeguarding channel and the contradiction of coercive power shortage. Both the main and the minor contradictions should be solved. So seeking both a temperory solution and a permanent cure is the countermeasure to solve the problem.This thesis based its research on the theory of administration and governance with good intensions, the administrative law theory, the civic participation theory, game theory, demand levels theory and externalities analysis theory. Such research methods as contradiction analysis, empirical analysis, qualitative analysis and quantitative analysis are used in this thesis.
