Analysis On The Application Of The Relative Centralized System Of Administrative Punishment Rights In Urban Management

With all the urban development, urban management study called a growing attention by scholars both at home and abroad. With the prevailing problems in law enforcement such as bullish enforcement, repetitive enforcement, expansion of law enforcement agencies,inefficient enforcement and enforcement-disturbing issues,local governments carried out the pilot project of Relative Centralized System of Administrative Punishment Rights under the leadership of the State Council from the mid-1990s, according to Article 16 in "The People's Republic of China on Administrative Punishment Law". The implementation of this system is of great significance for accelerating and deepening the reform of the administrative system, exploring the establishment of the socialist market economic system in line with the requirements of the law enforcement system,and improving the efficiency of law enforcement. The Relative Centralized System of Administrative Punishment Rights was a breakthrough in one of the direction of reform, and the governments from central to local have given much attention. After years of practice, the pilot work has achieved notable results,showing its vigor and vitality.However, the system in short period of time of practice has no successful experience to be shared, and still in the course of the implementation it also shows a certain issue,so it is in great need for in-depth study. At present, this work is still in progress to explore and try. Regardless the limitation of the legal system at all levels throughout the department of a comprehensive law enforcement officers in this area of theoretical research, the system is less in systemic, and vertical and horizontal integration of the analysis. Given the current status of the shortcomings of this system, there needs to be a greater force to the input-depth study of the topic to better play the role in practice and to better serve the urban development.So I work through personal practice and a lot of investigation , describe its development, practice as well as its positive effect.Some issues ,like legal status, segregation of duties, management system ,operational mechanism, free discretion, law enforcement, and anti-violence law ,were systematically summarized. And on this basis, I hope the research can promote the administrative penalty in the field ,and gradually expand to other fields,such as the transformation of government functions, the reform of the administrative system, and in a sense ,to provide some theoretical and practical reference.
