Because of the advancement of the fishing technology and the increase of demand for fish products, the marine fish resources which used to be deemed as inexcusable is facing the crisis of declining. The concept of sustainable development was raised more than 20 years ago, and the international management of fisheries moved toward this direction. Through the effort of the international community for more than 30 years, the deteriorating situation of marine fisheries has been alleviated. However, facing the austere situation of fisheries, the current system of international fishery management is exposed to have lots of deficiencies. Under the background of economic globalization, the prosperous international trade particularly fish trade makes the fishery problem more complex. The necessity and feasibility of the utilization of legal system of international trade to promote the management of marine fisheries are the main points of this paper. As to the concrete measures and system of how to use environmental trade measures (ETMs) to protect marine fishes are discussed in brief.There are five chapters in this article, mainly follow the order of raising the issue, analyzing the issue and settling the issue.The first chapter mainly introduces the current situation of marine fisheries, and emphasizes that because of the overfishing and illegal fishing, the marine fish resources is facing decline. This chapter also introduces the situation of fish trade, and emphasizes nearly half of the total catch flows into the international trade, which indicates the regulation of fish trade will have great impact on the whole fisheries. This is one aspect of feasibility of using ETMs to protect marine fishes.The second chapter mainly introduces the system of marine fisheries management. Besides introducing the achievement, this part emphasizes the deficiencies of the systems, which listed out without any rule and certainly are not completed. However, these deficiencies are enough to illustrate the necessity of using ETMs to protect marine fishes.The third chapter briefly introduces the ETMs. Nowadays, there are a lot of discussion about the relationship between environment and trade. Because of the length of this article, this issue is briefly discussed to educe the main subject of this paper.The forth chapter, key part of the article, mainly discusses the positive effect of ETMs upon the sustainable development of marine fisheries. The part is not very long, because the analysis and conclusion is based on the discussion of the third chapter, particularly the theoretical analysis of ETMs.The fifth chapter analyzes the reasonable nature of ETMs and the countermeasures of China on the basis of above discussion and reasoning. This part is very important, but because of the limitation of the study profundity of the writer, the content is relatively simple. To incorporate ETMs into the fisheries area was referred by others before, however, the systematic discussion like this article have rarely been seen. This article is hoped to have a little help for the further study in this area in the future. Also it is hoped this paper will bring some enlightenment for the practice.
