The Research On Enterprise Annuity Fund Trustee Regulation

As a supplement of the basic-old age insurance, enterprise annuity, which is of great significance for long-term social development, is the second pillar of old age security system. In order to standardize enterprise annuity, a reasonable enterprise annuity fund governance structure needs to be built. Trustee regulation whose result decides the future of enterprise annuity is the key to enterprise annuity fund governance structure. In this dissertation, by analyzing trustee regulation structure and comparing foreign legislations, the author points out the deficiencies of trustee regulation system in China and gives his research proposals. In this way, the author wants to provide some ideas for the trustee regulation.This dissertation adheres to the following ideas: basic theoretical analysis - foreign legislative reference - analysis of the present situation of China - recommendation. The article has three parts, which include the introduction, the main text and the conclusion.The introduction briefly describes the research status and the significance of the study, then makes a previous presentation of the main text.The main text is composed of four chapters totally. The first chapter analyses the basic content of enterprise annuity system, which includes the quality, the characteristic, the function and the content of enterprise annuity plan. The author analyses the legal nature of enterprise annuity fund, compares different types of enterprise annuity fund governance structure and selects trust-management structure for the optimal model, which lays research base for this dissertation. The second chapter analyses the trustee in the circumstance of enterprise annuity fund governance structure, which establishes the basis for the trustee regulation structure. Firstly, the author analyses the significance of trustee regulation according to the risk of enterprise annuity fund and the important position of trustee, which is the logic starting point of the article. Secondly, the author analyses the particularity of enterprise annuity fund trustee, which is the theoretical foundation of trustee regulation research. Finally, the author analyzes the starting point of trustee regulation—trustee's qualification and statutory duties and introduces trustee regulation.The third chapter sets up enterprise annuity fund trustee regulation system and analyses trustee regulation from internal and external perspective. This part is the emphasis of the text and also the center of the author's demonstration. The author analyses the internal regulation from trustee's obligations, responsibilities and the plan participants' rights and analyses external regulation from the supervision of intermediary organizations and regulatory agencies.Based on the study of the above chapters, the fourth chapter reflects enterprise annuity fund trustee regulation system in China and points out its deficiencies and puts forward research proposals. This is the purpose of the dissertation.The conclusion part summarizes this dissertation, gets conclusion and puts forward the research proposals.
