Study On The Establishment Of Environmental Liability Insurance System In China

The current environmental regulations of China are incompatible. Facing increasingly severe environmental pollution, in order to remedy the loss of victims adequately and protect the interest of polluters, we should establish the environmental liability insurance system. The theme of this dissertation is to analyze the environmental liability insurance system, raise some legal suggestions.This dissertation consists of four chapters.Chapter 1 raises the problems on compensation system in environmental tort. It's clear that establishing the environmental liability insurance system is very necessary by intruducing the particularity of environmental tort and the problems of the tort law.Chapter 2 introduces the environmental liability insurance system. First, this chapter introduces its concept and category. And then, this chapter studies the relationship between the environmental liability insurance system and the compensation system in environmental tort and other socialization of liability of compensation in environmental tort.Chapter 3 introduces and studies the enviromental liability insurance system of some foreign countries. It is inspiring to study the relative systems in the USA, Switzerland, Germany and France.Chapter 4 raises some legal suggestions. This chapter analyzes the lack of relative legislation of China, and gives some legal suggestions.
