A Study On The Compensation For China's Landless Peasants

Land is essential to farmers, which provide farmers with production, subsistence means and social security, and it plays a critical role that keeps rural political stability, economic development and social stabilization. The urbanization is an irresistible process, and our country is being in rapid urbanization process right now. As industrialization and urbanization process accelerated, part of agricultural land will inevitably transform into non-agricultural land, part of farmers will become"landless farmers". In the process of urban expansion the stronger land expropriation in rural areas increased, the more farmers become landless peasants. Because of their own quality,institutional,regulatory and other reasons, parts of landless peasants were unemployed,and they became new difficult groups; Part of farmers because of unreasonable compensation and unemployment,their livelihood is quite difficult.Based on a detailed review of relevant literature, the causes of landless peasants are discussed and legal status of them are analyzed by examining defects of land expropriation system and shortcomings of resettlement of landless peasants in this paper, and some suggestions of perfecting lost land compensation are provided.First of all, through the study of China's land expropriation system and evaluation of the reform process, compared to the current land expropriation system, whose shortcomings profoundly pointed out; On the comparison of historical condition, China's current land expropriation system and its main problems were pointed out.Then, in this paper it's analyzed from the cause and status of landless peasants,and its root was pointed out by comparison with the land expropriation of the past and the present, and its special status was established from a legal point; By the cognition of legal status of landless peasants, Landless peasants whose survive risks and institutional reasons were roughly citied. The existing right of resettlement of landless peasants was initially discussed,and it's defects were pointed from the placement of monetary and non-monetary, and it was expected that a more reasonable compensation mechanism of lost land was arrival at a comparative analysis. In addition, many scholars whose efforts in the field of lost land compensation were fully profited and cited in this paper and a more feasible accounting standard was obtained by judging from the economic point of view to re-explain the value of land and quantifying the land value as far as possible. A market-oriented, scientific and reasonable compensation for lost land was expected to be found so that it was ensured that landless peasants could live in a carefree manner by analysis of the nature, composition and standard of land price.Some policy recommendations were last proposed in this paper: Perfect the land expropriation procedures and control mechanism and prevent indiscriminate phenomenon; Clearly define public construction projects and strictly control the scale of land expropriation; vigorously promote conservation intensive land use and effectively reduce the occupation of cultivated land; further define the quality of cultivated land protection, improve the quality of farmland and management measures; seize and formulate relevant laws.
