Chinese Supervision System Of Trust Industry

The legal systems of the trust supervision include the supervision system, market access regulation, supervision to business activities and the exit regulation. Most of the current domestic researches are on the trust supervision, but is rare on the supervision system in this area. In this paper, we choose many research methods including historical analysis, comparative analysis, the jurisprudence analysis, and so on. Only from the supervision system of trust industry, we focus on the problems of the constitution set and the arrangement of the responsibility, involving the basic supervisory philosophy and supervisory mode. We try to propose to the revolution in trust regulation learning from the success experiences of foreign systems. And based on these results, we can improve the Chinese supervision system of trust industry. The first part is introduction. The second begins to outline the supervision system of trust industry, analyzing the definition of the concept, the scope, the significant and this discussion area. At the next part, we study on developing course of Chinese supervision system of the trust industry, raise the problems of Chinese supervision system and make up the theoretical analysis. Then it introduces and aggregates the advanced regulatory system of typical countries. At the last part of the article we come to the conclusion with relevant experience abroad: establish an independent authority, clear and definite the supervision philosophy and the supervision mode, and improve our supervision system of trust.
