Research On The Benefit Allocation During The Course Of The Suburban Land Expropriation In China

With the development of industrialization and urbanization,a great deal of agricultural land,especially in the suburb,has been expropriated since the 1990s. During the acquisition process,the present system of land-expropriating does not actually solve the problem between the peasants and their land.In some regions,land disputes which has replaced peasant burden,have became the main.reason for the conflicts of rural groups.Due to the functional diversity and fast land increment,the problem of,benefit distribution is more serious in the expropriation of suburban land. What is important for the economic development of cities is resolving the contradiction in the suburban land expropriation effectively.In this paper,I made a survey and get some data in the first place.Based on the economics principles and survey data,it analyzes the benefit distribution of suburban land expropriation and puts forward some suggestions.The content of the paper can be divided into five parts:The first part of this paper is on the writing background and research review of land expropriation.Many scholars has researched in this area,regarding the land expropriation system,the benefit distribution,the land acquisition compensation and resettlement of landless,and put forward a number of prevalent questions.However, the agreement upon the effective solution of benefit distribution is not yet be reached. We can learn a lot from the presence of foreign land expropriation and papers published by foreign scholars,such as the compensation scope and compensation methods.The second part gives a clear definition of the suburbs and analyzes the difference between suburban land and rural land.The main differences of suburban land are the functional diversity and the fast land increment.However,the theory of China's land expropriation originates from Marxism rent theory.Given right understanding and flexible application,land expropriation will become more reasonable and more accordant with the laws of economic development.The Government Defect Theory analyzes causes of problems in the land expropriation process from internal work efficiency of the government.These basic principles theoretically contribute to status analysis and posing problems.The third part sums up the changes of compensation standard in China.Land expropriation compensation had been from the situation which emphasized the settlement but ignored the compensation to the single currency compensation. Presently,there are various modes of compensation.Depending on different interest subjects,the paper describes the status of benefit distribution of China's rural land:the government still plays a key role but the village collective and farmers do not have too much autonomy.Combined with the characteristics of suburban land,the article sums up the main problems of benefit distribution of suburban land expropriation:(1) the contradictions of the functional diversification of suburban land and the single compensation standards;(2) the current land compensation system is incompatible with the rules of market economy;(3) land management laws and regulations related to the property rights of suburban land are lack of defining;(4) non-standard expropriation procedures and the low level of public participation;(5)the social security function of the agricultural land loses due to land expropriation.The forth part makes an analysis on the survey data from the New Zhengdong District.The investigation includes the peasants' rights and interests protection in the process of land expropriation,the farmer's cognition on the current land policy and the effect on the peasants' livelihood after land expropriation.Although the local government has made efforts in the land compensation,the peasants are not satisfied with the opaque process of land expropriation,unreasonable compensation standard, the missing social security and the affection of land expropriation on farmers' livelihood.They coincide with the problems from the analysis in the chapter 3,which shows their prevalence.The fifth part puts forward policy suggestions on solving the problems of the benefits distribution of suburban land expropriation:suburban land has its own unique features;therefore it is necessary to expand the scope of land expropriation.However the land expropriation compensation standards should also be guided by the market, making the price reflect the true land value.There are some ways to solve the problems of the benefits distribution of the land expropriation,including making the property transparent,which makes the farmers know their right to the land;making the land expropriation process more transparent,which gets the farmers really involved;providing social security benefits in a variety of ways.It Should be paid attentions on unfair distribution of benefits caused by the specificity and generality of suburban land expropriation,which will provide a guideline to the issue of benefit distribution of rural land in China.
