Land Expropriation Compensation:Realistic Predicament And Solution

With the constant development of economy and the continuous progress of the reform, the pace of urbanization is speeding up, the original town development pattern has already can’t meet the people’s increasing need of life, a brand new pattern will gradually emerge, be built and improved. The development momentum of urbanization will be more rapid especially after the18th CPC National Congress. The quickening of the process of urbanization will certainly lead to a large number of agricultural land being converted into construction land and a large number of rural collective land being expropriated. Land expropriation plays an important role in realizing town planning objectives, promoting urban outlook update, rational using of national land resources, and in improving the people’s daily lives. Since the relevant policies, laws and regulations are not perfect, the process of land acquisition can cause all kinds of contradictions and problems, which may cause distress to the development of the Times and the progress of harmonious society. Starting from various problems faced by land expropriation compensation, this paper defines the concept, the nature and characteristics of land expropriation compensation. With the public interest theory, land rent theory, property rights theory, game theory as the analysis tool, using comparison and inductive research method, qualitative analysis method, literature research method, empirical research method and other methods, studies and analysizes the current situation of land expropriation compensation, deeply discusses the dilemma of land expropriation compensation and in-depth analysizes the background and the reasons of the dilemma. Besides, by learning from some foreign thought, theory and system of solving difficulties in land expropriation compensation, this paper puts forward solutions and ideas to get out of the dilemma, and provides a theoretical basis and the reference suggestion in gradually improving the land expropriation compensation policy and and continuously revising the law.
