Research On China's Overseas Investment Insurance Scheme

The overseas direct investment of our country has been rapidly improved since the 90's of last century. Nowadays, China's direct investment increases 25% every year. Therefore, the fact that there will be more and more domestic enterprises investing abroad requires an effective policy to protect the interests of our foreign investment. Overseas Investment Insurance Scheme is a basic legal system in the protection system of the capital export country, which employs an efficient way to protect the interest and sate of the overseas direct investment systematically and directly. The main motive to establish such a system is to accelerate native investment to export and strengthen international competitive status by providing political risk legal guarantee for overseas private investment. China Export Credit Insurance Corporation started the overseas investment insurance practice in the year of 2002, and established the fundamental frame of our country's overseas investment insurance scheme. However, there still exist many problems. It is more important for us to build and perfect legislation insurance scheme in order to protect our foreign investment.In the first part of the article, the paper explains the basic issues of the overseas investment insurance scheme, including its concept, the system value and its different layout idea. In the second part, it analyzes the problems of our country's overseas investment insurance scheme. In the third part, after comparing and studying the overseas investment insurance programs in some developed countries such as America, Japan and Germany, the paper also summarizes the advantages and experience which we can introduce and use for reference. Owing to the coordination of the international insurance business, this article argues the related problems to multilateral investment insurance in the fourth part. Finally, at the fifth part of this article, combining the practice and the legislation of China's overseas investment, the paper analyzes the legislation of China's Overseas Investment Insurance Law in detail and makes suggestions on other aspects of the insurance scheme.
