A Study On China's Food Safety Legal Regulation

To the people foodstuff is all-important.The foodstuff relates to the human living and health.As economic globalization and international foodstuff business are increasingly expanding,the significant food safety events which endanger human living and health occur time and again, such as dioxin happened in Belgium and other countries in 1999 and foot-and-mouth disease burst out in Europe in 2001,etc.After the development of many years the quality of foodstuff in our country has been many serious problems,although we have a large quantity of food to meet the demand.For instance,in recent years,many food safety affairs like the SARS,avian flu,and "su dan hong",etc.Food safety has been paid more attention to by the China and even the world day by day.This paper tries to make an intensive study of the problems of our country's food safety from the point of view of legal regulation and propose some suggestions.It is divided into four parts:In pare one,the domestic and foreign present status of food safety are introduced briefly and the reasons of native food safety problems are analyzed compendiously.In part two,the main point is the present condition of foreign food safety law,and we need to use matured food safety lawmaking from international organization and developed countries like America,Germany, canada and Japan for reference.In part three,the author analyzes the present condition of our country's food safety law.In our country,the government attaches great Importance to food safety,and the basic frame of food safety rule of law has been set up after a long time effort.However,there are many deficiencies compared with the developed countries or International standards,e.g.the legal system isn't perfect,the coordination is poor, related legal system is inadequate and the penalty is light,etc.In the last part,some proposals are put forward to consummate our country's food safety law,including the principles and systems in law and other concrete legal countermeasures.In a word,nowadays food safety has been paid much attention to in the world in common,as economic globalization and international foodstuff business develops.It is a strategic task to have a healthy and perfect food safety legal system.We should promote the cooperation between China and developed countries,discuss the experience of settling the problems together,and gradually perfect the legal system of food safety in our country,in order to protect the people's health better,to make our society stable and to promote the development of foreign trade in our country.
