Study On Our Country's Nuclear Energy Safety Legislation

In today's world, because of energy shortage, the development and utilization of nuclear energy has become an important factor for China's sustainable development. But the history of the nuclear energy development shows that nuclear safety has been a problem of great concern to people. In the new century, with the increasingly rapid development of our economy, China consumes huge energy. In order to solve the problem of heavy dependence on imported energy and to meet energy demand imposed by the economic and social development, China put forward the policy of developing nuclear energy; thus, the issues related to nuclear safety has also aroused public concern. Nuclear energy safety is a systematic work, which involves science and technology, education, legal and other relevant means. As a relationship between social norms, the law has its special role. We must admit that, if China wants to foster the development of nuclear safety legislation, it is definitely necessary to study foreign and international legislation on nuclear energy safety; the process of reference and study is of significance both theoretically and practically to the improvement of China's legislation on nuclear security and safety.Nuclear energy is a kind of energy released from nuclear when the structure of atomic changes. Compared with conventional energies, nuclear energy is a clean energy. In the development and utilization of nuclear energy, including atom bombs and nuclear power plants, its security problems is nuclear radiation in the process of the use of nuclear energy and the impact of nuclear waste on the environment. International nuclear safety legislation includes the international treaties of prohibition and limitation of nuclear weapons, international conventions on emergency response of safety management about nuclear accident, management of radioactive waste, as well as the international conventions on international liability for nuclear damage. The nuclear safely legislation of some foreign countries has been more effective. Of course, China also attaches great importance to nuclear safety legislation. Our country's nuclear energy safety legislation, adopting the approach to the legislation of prevention first, safety first, aims to establish a more comprehensive nuclear safety supervision and management system, thus attaching great importance to international cooperation in the field of nuclear safety as well as the safety of radioactive waste management and. Our country's nuclear safety legislation is to be perfected; legislation architecture is defective, our country's Radioactive Pollution Control Act and Energy Law draft have some defect. To improve our country's nuclear safety legislation, the present thesis contributes some specific recommendations that the basic principles of the legislation should be adhere to, legislative structure should be improved, and Radioactive Pollution Control Act and relevant legislation should be modified. In particular, it is crucial to accelerate the formulation of a Nuclear Safety Act or Atomic Energy Act.
