Study Of The Core Tactics In Multinational Enterprises' Patent Strategy

Technology preponderance is one of those most significant advantages of multinational companies. The core of the technology preponderance is the technology invention and innovation capability. The transfer from such capability to preponderance relies on the protection of the intellectual property mechanism. The intellectual property has become the major non-tariff barrier. In recent years, intellectual property disputes between multinational enterprises and Chinese exports enterprises have been increasing. And the Chinese exports enterprises suffer major economic losses. Because Chinese enterprises don't pay importance on intellectual property rights, which leads to our enterprises facing huge pressure in intellectual property rights.This paper conducts a close research on the core tactics in multinational enterprises'patent strategy. First of all, based on the latitude of the enterprise competition edge and the patent value, employing the analysis method of the SWOT and Boston Matrixes, we find the most of multinational enterprises are positioned in the area with strong competitive power and high patent value. Multinational enterprises most adopt offensive patent strategies which include patent licensing strategy and patent litigation strategy; second, we establish a theoretical model of the best patent licensing strategy between a multinational enterprise and a host enterprise, Supposing the invention of the multinational enterprise is cost-reducing, we study how to choose patent licensing models which include the Fixed Fee Patent Licensing Model, the Royalty Licensing Patent Model, the Fixed Fee Plus Royalty Licensing Patent Model to get maximum benefits whether the patent technology is innovation crisis; We find : Supposing that patent technology is non-violent change innovation, when the degree of the cost discrepancy between the multinational enterprise and the host country enterprise is different, the three models are likely to be the best model, which is the same as the actual situation; Supposing that patent technology is violent change innovation, the multinational enterprise always chooses the Fixed Fee Plus Royalty Licensing Patent Model. Finally, we establish dynamic game model about patent malicious litigation between a multinational enterprise and a host country enterprise. analyze impact factors of the multinational enterprise and a host country enterprise's strategy based on the dynamic game model, analyze and solve the dynamic game model; and we introduce the whole case between Cisco and HuaWei, explore inspiration of the case for Chinese enterprises.
